About HM Original Art

HM Original Art is an independent art business offering original artwork, personalised calligraphy, art products and related creative goods. Additional products and services may be introduced from time to time.

Products and Descriptions

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and prices are accurate.

Please note the following:

• Colours may appear slightly different depending on your screen, device and display settings.

• Product photographs may illustrate previous examples, particularly for personalised products. Unless expressly stated otherwise, the artwork created for your order may differ from the example shown.

• Original artwork and handmade products may contain minor variations in colour, alignment, finish, texture or dimensions arising from the creative process and materials used.

• Measurements are approximate and may be rounded to the nearest centimetre where appropriate.

Minor variations that are consistent with the product description and reasonable expectations for handmade work do not necessarily constitute a defect.

Please read individual product descriptions carefully before ordering.

Orders and Customer Responsibilities

Customers are responsible for providing accurate contact, delivery and customisation information.

For personalised orders, please carefully check the spelling of names, wording, dates, colour choices and other details supplied before checkout. We may contact you to clarify incomplete or conflicting instructions.

HM Original Art cannot be responsible for errors resulting solely from incorrect or insufficient information supplied by the customer.

An order is subject to successful payment and acceptance by HM Original Art. If we cannot fulfil an order, we will contact you and arrange an appropriate refund where required.

Custom Artwork and Personalised Products

Custom artwork is created according to the specifications agreed upon with the customer.

Please ensure that you understand the available options and provide all required information before placing your order. Once production has begun, changes may not be possible or may require an additional charge agreed upon with you in advance.

Copyright and Intellectual Property

Unless otherwise agreed in writing, all original artwork, calligraphy, illustrations, designs, photographs, written content and other creative materials produced or published by HM Original Art remain the intellectual property of their respective rights holder.

Purchasing an artwork or product does not transfer copyright or grant permission to reproduce, copy, distribute, adapt, sell or commercially use the artwork or design.

Customers may display purchased physical artwork for personal use. Any reproduction or commercial use requires prior written permission from the relevant rights holder, unless permitted by law.

No part of this website or its original content may be reproduced or used commercially without appropriate authorisation.

Portfolio and Social Media Sharing

HM Original Art may share photographs of completed artwork on its website, social media platforms and other promotional materials, subject to the following practice.

Artwork featuring a single first name may be shared where the post and its surrounding context do not disclose other identifying personal information.

Before sharing artwork containing a name and surname, a couple’s names or a set of family name’s, HM Original Art will obtain appropriate permission from the relevant person or people. Where the artwork contains a child’s full name, permission will be sought from the appropriate parent or guardian where required.

Artwork purchased as a gift for someone else containing their full names or family names, will not be shared where the necessary permission from the relevant person/people has not been obtained.

Customers may contact HM Original Art if they have concerns about the public sharing of their commissioned artwork.

Permission to share artwork does not transfer copyright or grant the customer any additional intellectual-property rights.

Pricing and Payments

All prices are displayed in South African rand (ZAR), unless expressly stated otherwise.

Applicable delivery charges and other mandatory fees will be disclosed during checkout before the order is placed.

Prices may change without notice, but a price change will not alter an existing accepted order unless otherwise agreed or required by law.

Payment must be made using the payment methods available at checkout. Orders may not be processed until the required payment has been received or confirmed.

Website Content and Availability

We make reasonable efforts to keep the website accurate and available. However, products may become unavailable, and occasional errors or interruptions may occur.

If an error materially affects your order, including its price or availability, we will contact you to resolve the issue.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or products.
